We’ve recently received enquiries about illness at the Steigenberger Aqua Magic, where it appears that there may be problems that are causing British tourists to suffer from gastric illness in the popular Hurghada resort where there may be a problem with Campylobacter. This is not the first time that we have been contacted about this Thomas Cook hotel, which we are currently in the process of claiming compensation on behalf of a family who suffered a gastric illness.
Problems at Hurghada waterpark
The Steigenberger Aqua Magic is located in the popular Hurghada resort of Egypt. Advertised by UK tour operator Thomas Cook as an all-inclusive that features a range of aquatic activities, restaurants and even adult-only areas, this Egyptian waterpark hotel should be an ideal choice for any sun seeking family on holiday. Having only opened their doors back in January of 2014, the hotel has been experiencing problems with illness, which over two years later are unlikely to be due to teething problems.
Holidaymakers suffer diarrhoea and stomach pains
We have recently received enquiries from holidaymakers who suffered what appears to be a gastric illness while staying at the Steigenberger Aqua Magic. All members of the group who have contacted us suffered from symptoms that included diarrhoea and stomach pain, something that nobody wants to experience when they’re such a long way away from home. One of members of the group that we are now representing has informed us that they have received confirmation that they have suffered from a Campylobacter infection.

This is not the first time that we have been received reports of illness at the Steigenberger Aqua Magic, and we have previously been contacted by a family who suffered from illness while staying at the Hurghada hotel back in May of 2015. The affected holidaymakers informed us that they had concerns over food hygiene at the Steigenberger, reporting to us that the buffet was left uncovered for long periods of time, with hot food being served lukewarm and even cold. Conversely they noted that the ice cream in the hotel restaurant was not frozen. Our clients also told us that they regularly saw flies and birds in the hotel restaurants, found that the cutlery and glasses were often dirty, with utensils being used on multiple dishes.
Since we took on this claim; infection that was likely caused by their stay at the Steigenberger Aqua Magic. This case is still on-going as the family are suffering from continuing symptoms over a year since their initial illness, but in that time Thomas Cook have admitted liability, and it’s likely that the family will receive substantial compensation for their ruined holiday.
Possibility of a group claim
It’s possible that these reports of illness are not isolated, and there could be further problems at the Steigenberger Aqua Magic that have yet to be addressed. If this is the case we might continue to see more reports from sick holidaymakers who travelled to the Hurghada hotel, unaware of any potential problems, and if guests keep becoming ill, a group action will become a reality. If this happens those claiming may benefit from the evidence shared by others, creating a stronger argument that is more difficult for the legal teams of big tour operators to refute.
Can I claim?
If your package holiday has been ruined by illness at the Steigenberger Aqua Magic, then under The Package Travel Regulations 1992 (PTRs), your tour operator could be held responsible. The PTRs are in place to ensure that your tour operator takes reasonable steps to make sure that every aspect of your package holiday that they sell to you for a single price does not cause you to come to harm. In the event that they fail in this endeavour, they could be liable, even if your illness is caused by a third party supplier such as the hotel restaurant on your all-inclusive break abroad.
