Holiday Illness Claims Manager
Thomas Cook has agreed to compensate our client following a holiday from hell at the Iberostar Diar El Andalous in Port El Kantaoui, Tunisia. The holiday was spoilt following a severe bout of gastroenteritis, the resultant illness being caused by the bacterial infection salmonella.
The holiday was ruined by this holiday bug which is commonly linked to food poisoning associated with undercooked chicken or egg products.
The classic symptoms associated with salmonella food poisoning include bouts of diarrhoea, headaches, fever, abdominal cramps and vomiting.
Simon Lomax, Simpson Millar’s, Holiday Illness Claims manager said:
“Holidaymakers can be severely ill with salmonella and it is occasional fatal, in elderly, very young or sick people. Large numbers of living bacteria must have been present in the food served at the Iberostar Diar El Andalous otherwise the bug would have been destroyed by acid in the stomach.”
“My client was severely ill suggesting that the salmonella passed to the small intestine where the near-neutral conditions allowed them to multiply rapidly causing sickness.”
“The infection was confirmed following stool samples taken upon our client’s return to the UK.”
Letter to Thomas Cook
Simon continued – “As a consequence of this diagnosis I wrote to the tour operator alleging that The Iberostar Diar El Andalous Hotel:
- Exposed my client to the risk of ingesting salmonella;
- Failed to institute, monitor or enforce any or any reasonable system of food hygiene;
- Failed to cook food properly and left it out for long periods allowing bacteria to multiply; and
- The accommodation provided was not reasonably safe and not of the 4 star standard advertised.
Thomas Cook has admitted breach of duty and agreed to compensate our client subject to the provision of a medical report.”
Food Poisoning claims
Holidaymakers who experience salmonella food poisoning whilst on a Thomas Cook package holiday are able to claim compensation pursuant to the 1992 Package Travel Regulations. It is anticipated that this Salmonella food poisoning claim will warrant significant compensation.
